大陸國家智慧財產權局宣佈:恒生科技的丙爾金專利無效

大陸國家智慧財產權局對三門峽恒生科技研發有限公司的發明專利——鍍金用檸檬酸一鉀二(丙二腈合金(I))及其一水合物的製備方法進行複審後，於2014年11月4日宣佈該專利無效。國家智慧財產權局對丙爾金專利宣佈無效的決定要點為：對於化合物的製備方法發明專利而言，如果本領域科技人員根據專利給出的技術手段難以確定該方法制定產物就是目標化合物，則專利權人還應提供相應的證據以證明通過所述方法能夠製備得到所述的目標化合物，在此前提下，如果專利權人未能提供相應的證據或者所提供的證據明顯不實，則該專利說明書對化合物的製備方法公開不充分。
而在審查丙爾金這項專利中，國家智慧財產權局發現，“對於本領域技術人員而言，不管是哪種測試譜圖，即使是技術嫺熟的分析工作者，用最精密的儀器，用同一種方法，對同一個樣品進行多次測量，也不能得到完全一致的結果，這說明客觀上存在著難以避免的誤差……”而丙爾金的專利說明書也未對全力要求1-23的技術要求做出清楚、完整的說明，不符合專利法第26條第3款的規定。因此，國家智慧財產權局宣告鍍金用檸檬酸一鉀二(丙二腈合金(I))發明專利全部無效。(新聞來源：PCB資訊網)
